These Terms and Conditions ("Agreement") govern the use of the website HeartfulCraft.com ("Site"), owned and operated by HeartfulCraft ("Company"). By accessing, browsing, or using this Site, the user ("User" or "Buyer" or "Merchant Exporter" or "Reseller") agrees to be bound by the full terms of this Agreement.

This Agreement constitutes a legally binding contract between the User and HeartfulCraft. If you do not agree to these terms, you must not use this website or make any purchases.

1. DEFINITIONS

1.1 "Company" refers to HeartfulCraft, a registered entity involved in the sourcing, customization, and export of handcrafted Indian artisan products.

1.2 "Products" refers to any handicraft item listed on the Site, including but not limited to pottery, woodwork, textile, bags, and home decor items.

1.3 "User" includes all individuals or entities accessing the website, including international wholesale buyers, merchant exporters, resellers, and sample requesters.

1.4 "Merchant Exporter" refers to a third-party Indian citizen or resident who promotes, sources, or markets HeartfulCraft products for commission.

1.5 "Order" means the confirmed request for Products made by a User, which is paid in full in advance and accepted by the Company.

2. NATURE OF PRODUCTS AND HANDCRAFT DISCLAIMER

2.1 All products sold by HeartfulCraft are handcrafted using traditional artisan techniques. Due to the nature of handmade processes:

No two products will be exactly identical
Natural irregularities in size, texture, color, and design are expected
Minor cracks, brush marks, color gradients, polish variations, grain texture, and non-uniformity are part of the product’s authentic identity

2.2 These variations are not defects and do not constitute grounds for returns, refunds, or complaints.

3. ORDERING POLICY

3.1 All orders, including samples and bulk, are subject to full upfront payment. No part-payment, installment, or Cash on Delivery (COD) option is available or accepted.

3.2 Sample Orders are minimum 10-piece packs. Variations in color and pattern are allowed within sample packs.

3.3 Bulk Orders require a Minimum Order Quantity (MOQ) of 100 units per product type. Any customization or branding requests are available only for Bulk Orders and must be clearly documented and confirmed in writing before payment.

3.4 No verbal agreements or undocumented commitments will be honored. All specifics must be confirmed in formal writing and acknowledged by both parties.

4. PAYMENT POLICY

4.1 The User must make full payment in advance using the payment methods provided on the Site.

4.2 Once payment is confirmed, the Order will be processed. No change requests or cancellations will be accepted after payment.

4.3 HeartfulCraft shall not be liable for any international currency conversion charges, bank processing fees, or taxes paid by the User.

5. SHIPPING AND DELIVERY

5.1 All Products are shipped using reputed international courier partners. Estimated delivery timelines are provided but not guaranteed.

5.2 HeartfulCraft is not responsible for delays arising from customs, natural disasters, transport issues, strikes, war, or government restrictions (force majeure).

5.3 The User is solely responsible for import duties, taxes, customs regulations, and legal compliance in their respective country.

6. RETURN, REFUND, AND CANCELLATION POLICY

6.1 NO RETURNS, REFUNDS, OR CANCELLATIONS will be entertained under any condition. This includes but is not limited to:

Buyer’s remorse
Product not matching buyer expectations
Custom products not matching taste or aesthetics
Delayed shipments
Broken/damaged products due to shipping unless proven negligence by the Company pre-dispatch
Rejection by reseller’s customer or third party

6.2 Once payment is received and the transaction is initiated, the sale is deemed final and non-reversible.

6.3 Refunds will only be issued in the rare event where:

The order is paid but not shipped due to internal Company error (with valid proof)
A product promised in the written order is completely missing or misrepresented and acknowledged by Company

7. LIABILITY LIMITATION

7.1 The Company, its employees, contractors, or agents shall not be liable for:

Any indirect, consequential, punitive, or incidental damages
Loss of profit or business interruption
Disputes between the buyer and end-consumer

7.2 Maximum liability of the Company under any circumstances shall not exceed the amount paid for the relevant product order.

8. INTELLECTUAL PROPERTY

8.1 All content on the Site, including but not limited to images, logos, text, design, and product data, are the exclusive intellectual property of HeartfulCraft.

8.2 Unauthorized reproduction, commercial use, reselling, or copying is strictly prohibited and may lead to legal action.

9. MERCHANT EXPORTERS / THIRD-PARTY AGENTS

9.1 Merchant Exporters operate independently and are not employees, partners, or legal representatives of HeartfulCraft.

9.2 Any leads or buyers generated through their effort will be processed by HeartfulCraft directly. Commission shall be payable on qualified bulk orders at agreed percentages, as per written reseller agreements.

9.3 Any false promises, personal commitments, or misrepresentation made by the Merchant Exporter to third parties will be their sole responsibility.

9.4 Resellers or Merchant Exporters cannot initiate refunds or cancellations on behalf of their clients. HeartfulCraft deals only with the actual paying buyer.

10. COMMUNICATION POLICY

10.1 The Company does not offer direct phone or live chat support.

10.2 All support queries must be submitted through designated forms or email channels mentioned on the Site.

10.3 Harassment, repeated calls, or undue interference with Company staff or backend support will result in permanent blacklisting from future dealings.

11. MODIFICATION OF TERMS

11.1 HeartfulCraft reserves the right to modify, revise, or update these Terms at any time without prior notice. Users are advised to review this page periodically.

11.2 Continued use of the Site after such changes constitutes acceptance of the updated Terms.

12. LEGAL JURISDICTION

12.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of India.

12.2 All disputes shall be exclusively subject to the jurisdiction of the courts located in India. The Company shall not entertain legal proceedings or claims outside Indian jurisdiction.

13. ACCEPTANCE OF TERMS

By using HeartfulCraft.com, placing an order, or submitting any form, you confirm that:

You fully accept these Terms and Conditions
You understand the nature of handmade products and payment obligations
You waive your right to claim any refunds, returns, or reversals post-payment
You indemnify and hold harmless HeartfulCraft, its team, and its artisans from any future claims, disputes, or liabilities arising from the transaction
